Definitions

The Company: Acc-Sys Software Ltd, 198 St Helens Street, Ipswich, IP4 2LH
Application or Program: Bespoke software developed by the company
Site: Web site or web application developed by the company
Services: Services that we provide ourselves or through third parties
Customer: The client requesting the application, site or service from the company
Code: Short term for source code, whether that is for an application or site
Bug: Term for undesired or unrequested features that may be present in an application or site
Working Day: Mon-Fri 8am to 6pm excluding bank holidays and other days we may publish in advance

General

By using applications, sites or services, you agree that we can process your data in line with our privacy policy.

All code remains copyright the Company. Source code may be purchased under a separate agreement to the development of an Application.

Whilst every endeavour will be made to limit Bugs in Applications and Sites, we cannot be held responsible for any resulting complications through such Bugs.

We will always endeavour to make all Applications and Sites transmit and store data in the most practical, secure way possible at the time. We will regularly review data transmission and storage to update to more secure methods when then become available.

Some of our Applications and Sites come with a licence, which must be paid for within our standard payment terms once invoiced. Failure to renew an Application or Site licence in time may result in the Application or Site stopping.

We reserve the right to withdraw our Applications or Sites are any time. This will be done through a letter with 30 days notice.

Support is not included with any of our Applications or Sites but can be purchased separately on a fixed or pay as you go basis. Support may include help with using the Applications or Sites or for fixing Bugs that may arise.

We will endeavour to provide software support appropriate to the priority of the support requested. Urgent support items will always get priority.

We have no control over the terms & conditions and Privacy policy of our third party suppliers. Where we provide a service from a third party, we can provide on request a link or copy of the third parties terms & conditions or privacy policy.

Acc-Sys Cloud Accounts

We will patch servers and Databases on a regular basis but cannot be held responsible for data breaches where there is no patch available.

The onsite Applications we provide are the access to the data. If you lose a computer with these Applications or think a copy may have been taken, then you must contact us immediately for the data access password to be changed. We will then issue a new set of Applications. We accept no responsibility for any data losses where we have not been notified and within the 30 minute period it may take to change an access password.

A nightly backup will be stored. You may request we restore to a nightly backup, which will result in the loss of all data entered from that point. We can increase the regularity of the backups on request, which may incur an addition fee.

Any data breaches detected will be reported in line with our privacy policy.

Acc-Sys On Site Accounts

If you have a support contract in place, we will patch servers and databases etc as we do for Acc-Sys Cloud Accounts. Otherwise it is the clients responsibility to apply all patches.

Backups are the clients responsibility but we can recommend and supply a solution if required. As a provided backup solution would be from a third party, we would not accept any loss of data through the third party Application not performing as expected.

Acc-Sys Cloud & On Onsite Accounts

As part of the HMRC Making Tax Digital (MTD) submission, we will security transmit background data requested by HMRC. A copy of such data can be provided on request. The data requirements from HMRC may change and we will not notify you of the changes unless it is a direct statutory requirement that HMRC requires you to enter or fulfil.

You will always be given an opportunity to review VAT and Tax data prior to submitting to the data to HMRC for MTD. The client is responsible for making sure the data is correct.

By accepting these terms, you authorise us to transmit data on your behalf to and from HMRC.

Cloud Servers & Web Hosting

Payment terms

Our standard payment terms are 30 days from date of invoice.

Certain products are services require payment with order or a deposit. The client will be informed of this on the quotation.

The company reserves the right to alter payment terms and also refuse credit altogether.
